THE FOLLOWING TERMS AND CONDITIONS OF USE AGREEMENT (hereafter “Terms”) governs your use of our Website. It is important that you read the Terms carefully, as your use of the Website will automatically constitute your agreement to be legally bound by the Terms and Conditions set out herein. These Terms also govern your use or purchase of the products/services provided through or in connection with the Website. Each time you use our Website, you acknowledge that you have read these Terms and agree to be legally bound by them. • "Products and Services” shall mean all products and/or services provided directly by Yoga Essence Project, including all products for sale and services offered under the "Product" page and "Yoga Themes and Yoga Sequences" pages;

The Website is governed by the following Terms and Conditions:

 

1. Ordering Products from us
   We have very carefully and as accurately as possible described and show our Products. The product information is included under each product page. If you need further clarification or need more details, please contact us at support@yogaessenceproject.com
   
   Product images are for illustrative purposes only. Although we have made every effort to display colors accurately, we cannot guarantee that your computer’s display of the colors accurately reflect the color of the products. Your products may vary slightly from those images.
   
    

2. Pricing
   We make every effort to make sure that the pricing displayed on our website is correct. However, if an error in the pricing of a product is found we reserve the right to either cancel your order or contact you to arrange payment of any extra sum due or refund any over-payment made by you (as applicable). We reserve the right to alter all products pricing without notice.
   
   Prices on the website are inclusive of Sales tax and VAT.
   
    

3. Ordering of our Products
   You can place an order with us by ordering via our online checkout process. During the checkout process you can review your order to prevent any errors in ordering. We will send you an order confirmation with the order details.
    
   We reserve the right to cancel any order for any reason. Possible reasons for cancellation include, but are not limited to the following: fraudulent or potentially fraudulent orders, incorrect pricing, product becomes unavailable, if we do not deliver to your area or non-payment.
    
   If your payment has been processed but we do not accept it, we will re-credit your account with any amount deducted by us from your debit or credit card as soon as possible, but within 30 days of your order. We will not be obliged to pay any additional amount as compensation for disappointment or any other unforeseen reason.
   
    

4. Payment
   Payment can be made by any of the options available on our Website. Payment shall be due before delivery. If your payment fails, your order will be cancelled.
   Please be aware that if you are using Paypal as your payment method we reserve the right to not ship to unconfirmed addresses.
   
    

5. Returns and Refund
   If you are not satisfied with a Product that you purchased, you are eligible for a full refund of amounts paid for that Product. Email us at: support@yogaessenceproject.com no later than fourteen (14) days since the date you received the product(s).
   You have a further 14 days to return the item(s) once you have told us about your cancellation.
   
   We will process the refund without undue delay, and not later than:
   
   • 14 days after the day we receive back from you any product(s) supplied, or
   • (if earlier) 14 days after the day you provide evidence that you have returned the goods, or
   • if there were no goods supplied, 14 days after the day on which we are informed about your decision to cancel this contract.
   
   Please be aware that you are obligated to bear the direct cost of returning the Product(s). You are liable for any diminished value of the product(s) resulting from the handling other than what is necessary to establish the nature, characteristics and functioning of the product(s).
   
   If we shipped you the wrong item or your product(s) arrive damaged or in poor condition, simply email us a digital photo of the incorrect or damaged item and container to support@yogaessenceproject.com. Please include the following in the email: your order number, the shipping ID number or item number, a short description of the reason for the return and please tell us if you are seeking for a replacement or a refund. Your request will be processed within 72 hours. If you select refund, you will be refunded the full price of the product, exluding the cost of delivery.

        6. Website content and Proprietary Rights

        The Photography, Products and Services used on the website are fully copyrighted. It is prohibited to publish, reproduce, modify,    

         distribute, sell, re-sell, share, exploit or create derivative works from any of the Products and/or services.

      As between you and us, we own the Products and Services, and any and all graphics, photographs, images, artwork, text, and the contents,        design, layout, functions, appearance and other intellectual property, comprising the Services. The foregoing ownership rights include all            Intellectual Property Rights inherent in or appurtenant to the Services.

      Without limitation of the foregoing, the Services contain proprietary material of Katarina Svabcikova, which is protected by

      copyright  and other laws respecting proprietary rights. The Services are also protected by copyright as a collective work and/or    

      compilation, pursuant to U.S. copyright laws, international conventions, and other copyright laws. Katarina Svabcikova retains all

      rights in the Services, including all copyright and other proprietary rights worldwide in all media. You may not use the Services except as

      expressly permitted under these Terms.
